ANWAR IBRAHIM 'S SODOMY TRIAL: Anwar seeks to remove judge

KUALA LUMPUR: The second sodomy trial of Parti Keadilan Rakyat (PKR) de facto leader Datuk Seri Anwar Ibrahim has been postponed to tomorrow after the accused made an application for the trial judge to recuse himself from the trial this morning.

Anwar's lawyer, Karpal Singh, made the application for judge Datuk Mohamad Zabidin Mohd Diah to disqualify himself on grounds that the latter had refused to cite local Malay daily Utusan Malaysia for contempt of court over a front-page article headlined "Tak Rela Diliwat Lagi".

In his application, Anwar said the daily had, on Feb 4, published the article with his photograph and plaintiff Mohd Saiful Bukhari Azlan on either side, as well as another article on page three under the headline "Berhenti Kerana Tidak Mahu Diliwat Lagi".

"My counsel applied to cite Utusan Malaysia for contempt of court as what was published amounted to that," said Anwar.

"However, the learned trial judge dismissed my counsel's application on grounds that the said reports were not committed in court and that the reports were not carried with the intention of being mischievious and to distrupt trial proceedings."

In his affidavit which was filed at the court registry at 9am today, Anwar said Utusan Malaysia had again featured on its front-page,  on Feb 5, a photograph captioned "Mohd Saiful Bukhari Azlan menunjukkan katil di bilik tidur utama tempat beliau mendakwa diliwat Anwar Ibrahim kepada Hakim Mohamed Zabidin Mohd Diah (kiri) ketika melawat kondominium.

Tempat kesalahan itu didakwa dilakukan di Unit 11-5-1 Kondominium Desa Damansara, Jalan Setiakasih, Bukit Damansara, Kuala Lumpur, semalam".

He said his counsel had urged the judge to caution the newspaper for having carried the photograph and caption, and had stressed that the caption adverted to the bed and not the place where the alleged offence took place, adding that the report was, therefore, misleading rather than adverting to proceedings which had been in camera earlier that day.

Anwar said the lead counsel for the prosecution, Solicitor General II Datuk Mohd Yusof Zainal Abiden, opposed his lawyer's application to the judge.

"The learned trial judge declined to caution Utusan Malaysia, and to my utter amazement and disbelief, ruled that the publication of the bed pictures as evidence that had been given in court the previous day!"

Anwar stated in his affidavit that this pronouncement by the judge is not derived by what actually transpired in open court or in the notes of proceedings, both written and audio.

In the affidavit, Anwar said the ruling made by the judge was adverted and brought to surface an element of real danger of bias on the part of the learned judge.

At this morning's hearing, Mohamad Zabidin said he would hear Anwar's application for him to be recused tomorrow.

Some malaysian friends told me that hurling abuses at the police is against the law and I read something about the Drama King calling your former top police officer a goverment dog and the Drama King showed up at court with a black eye. Makes me wonder who actually got him the black eye? Makes me wonder again..... would this so called leader with a high respect within the islamic world really call someone, more so a fellow muslim a dog? I really wonder what would his sleeping partners wearing the turbans really are thinking now? My malay driver said that muslims are not allowed at all to call anyone other than the person's name. Week in and week out... the so called Pakatan Rakyat is looking more like Pakatan Rosek or Pakatan Ruboh, forgive my malay please. My malay driver says that it is Pakatan Riuh.

Apparently, i was told by a malaysian student on the same flight to the US with Drama King , he was wheel chaired to the plane and wore the neck collar all the way and immediately stood up and removed the neck collar soonest the plane landed!!! Well..... well..... well.....

He always like boys since his UNI day.Alot of people knew it but kept quiet. Hope he gets convicted and put in jail for good.He's not doing any good for the opposition anyway just talk and talk untill today nothing has been done. I pity his blind supporters.One day they will realize that he is just a big fat lair.. Oh well this is MALAYSIAN POLITICS don't you just love the drama..

Please don't waste tax payers' money by prolonging the trial. The only good thing coming out of this is the sensation it causes as news fodder. Saudara Anwar, tell the truth and accept the judgment that comes with it.

The opposition newspapers are reporting false and malicious reports on a daily basis...its even worse. Come on Anwar, what more ideas do you have to divert the public attention. This time round, no more "black eye"..but i am very sure and i bet with everyone to my last dollar that if or when Anwar is convicted, the first drama that he will do is - MEDICAL. He will start to wear neck brace again and his so called chronic back pain will start to appear again.. Dont be a coward....if you are really innocent, just prove it in court..

Well...the great Drama King will never cease to try anything, including the " back way " to delay this much anticipated trial. My malay amah told me of a malay proverb " berani kerna jujor, takut kerna bohong. " Where are the thousands that used to follow him from behind - maybe they have realised that they have been played from " behind " too?

Removing the Judge requested by the defendant is fair so long as there is a strong chronology that shows the Judge is showing double standard.
